Terms applicable to publications, training and advisory services on MERCOSUR Trade Hub

Publications, training and certifications — MTH Publishing — AVBM Sàrl, Lausanne
These Terms of Sale (hereinafter "Terms") govern all sales of publications, training programmes, seminars and certification programmes offered on the MERCOSUR Trade Hub website (hereinafter "the Website"), published and marketed by MERCOSUR Trade Hub Publishing, an editorial brand of AVBM Sàrl, headquartered in Lausanne, Switzerland (hereinafter "the Publisher").
The products and services covered include:
• Digital guides and reports (PDF) — downloadable after purchase
• Professional template packs — compliance and analysis templates
• Sector reports — market analyses and specialised studies
• MERCOSUR Navigator certification programme — professional training with assessment
• Training courses, seminars and masterclasses — in-person or online
Any order placed on the Website implies unreserved acceptance of these Terms. The Publisher reserves the right to modify the Terms at any time. The applicable Terms are those in force on the date of the order.
The publications, training courses, seminars, masterclasses and certification programmes offered by MERCOSUR Trade Hub Publishing (editorial brand of AVBM Sàrl, headquartered in Lausanne) constitute editorial and educational products.
They do not constitute individualised legal advice within the meaning of the Federal Act on the Free Movement of Lawyers (LLCA/BGFA) and do not create any lawyer-client relationship between the buyer and the author of the content or any other person.
Buyers acknowledge that the application of the content to a specific situation is their sole responsibility or, where applicable, that of the qualified advisor they choose to consult.
For legal advice tailored to a specific matter, readers are invited to contact a lawyer registered with the bar of their jurisdiction, or to schedule a confidential consultation via mercosurtradehub.com/contact.
Prices are displayed in euros (€) and include all applicable taxes. The Publisher (AVBM Sàrl / MTH Publishing) is not subject to Swiss VAT (Art. 10(2)(a) VATA) below the CHF 100,000 annual turnover threshold.
Payments are processed securely by Stripe, Inc. (https://stripe.com), a PCI DSS Level 1 certified provider. Accepted payment methods include credit and debit cards (Visa, Mastercard, American Express), as well as other methods offered by Stripe depending on the buyer's country.
The applicable price is that displayed on the Website at the time of order validation. The Publisher reserves the right to modify prices at any time, without retroactive effect on orders already placed.
Invoices are issued in the name of AVBM Sàrl (MTH Publishing), Lausanne, Switzerland. The bank descriptor appearing on the buyer's statement is "MTH PUBLISHING".
Digital products (PDF guides, templates, reports) are made available immediately after payment confirmation, as a download or via online access.
The MERCOSUR Navigator certification programme is accessible online after registration and payment. Access is personal and non-transferable.
Training courses and seminars are accessible according to the terms specified at registration (date, venue, connection link).
In the event of a technical issue preventing access to a purchased product, the buyer is invited to contact the Publisher at [email protected]. The Publisher undertakes to resolve the issue promptly or propose an alternative solution.
In accordance with Art. 40a et seq. of the Swiss Code of Obligations (CO) and Directive 2011/83/EU:
Downloaded digital products: The right of withdrawal does not apply to digital content supplied on a non-tangible medium where performance has begun with the consumer's express consent (Art. 16(m) Directive 2011/83/EU).
Digital products not yet downloaded: The buyer has 14 days from the date of purchase to exercise the right of withdrawal.
Training and seminars: Cancellation is possible up to 7 days before the session date. Beyond this, no refund is due.
Certification programme: The right of withdrawal expires upon first access to the training content.
To exercise your right of withdrawal, send an email to [email protected]. The refund will be made via the same payment method within 14 days.
All publications sold on the Website are protected by Swiss copyright law (CopA, SR 231.1) and applicable international conventions. Copyright is held by AVBM Sàrl (MTH Publishing).
Purchasing grants a personal, non-exclusive, non-transferable licence. The buyer is authorised to:
• Download and retain a copy for personal or internal professional use
• Print the product for personal use
The buyer shall not:
• Resell, redistribute or make the product available to third parties
• Modify, adapt or create derivative works without written authorisation from the Publisher
• Use the product in commercial training delivered to third parties without a specific licence

The legal advisory, negotiation and compliance services offered via the Services page of the Website are provided by Alessandro Brenci, Attorney at Law registered with the Bar of the Canton of Vaud (Switzerland), practising under the professional structure BRENCI. Attorney — Advisory — Negotiation.
These services fall within the practice of the legal profession within the meaning of the Federal Act on the Free Movement of Lawyers (LLCA/BGFA, SR 935.61) and are subject to professional secrecy under Art. 13 LLCA.
The relationship between the lawyer and the client is governed by a mandate within the meaning of Art. 394 et seq. of the Swiss Code of Obligations (CO). Specific conditions (fees, scope, deadlines) are agreed individually in an engagement letter or mandate agreement.
Professional liability insurance is maintained in accordance with the requirements of the Vaud Bar.
All information communicated within the framework of a legal advisory mandate is covered by the lawyer's professional secrecy under Art. 13 LLCA.
This protection extends to all communications, documents and exchanges between the lawyer and the client, including the very existence of the mandate.
Professional secrecy may only be waived by the client or, in cases provided by law, by a competent judicial authority.
This confidentiality obligation is distinct from and independent of the editorial regime of Section I of these Terms. Data collected under an advisory mandate is never shared with the editorial activity.
For publications and training (Section I): The Publisher's (AVBM Sàrl / MTH Publishing) liability is limited to the amount actually paid by the buyer for the product concerned. The Publisher shall not be held liable for decisions made on the basis of the content acquired.
For legal advisory services (Section II): The lawyer's liability is governed by the rules applicable to the legal profession, including Art. 394 et seq. CO and the ethical rules of the Vaud Bar. Professional liability insurance is maintained.
In both cases, the user is invited to verify the suitability of the information or advice to their specific situation.
Personal data processing is governed by the Swiss Federal Act on Data Protection (FADP, SR 235.1) and, for EU residents, by the General Data Protection Regulation (GDPR, EU 2016/679).
Editorial data (Section I): Data collected during a purchase (name, email, billing address) is processed by AVBM Sàrl (MTH Publishing) solely for order fulfilment and editorial communication. It is not shared with the legal advisory activity.
Advisory data (Section II): Data communicated within a legal advisory mandate is covered by professional secrecy (Art. 13 LLCA) and processed exclusively by Alessandro Brenci, Attorney at Law. It is not shared with the editorial activity.

These Terms are governed by Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
In the event of a dispute, the parties undertake to seek an amicable solution within 30 days. Failing agreement, any dispute shall be subject to the exclusive jurisdiction of the courts of Lausanne, Canton of Vaud, Switzerland.
For consumers residing in the European Union, the mandatory consumer protection provisions of their Member State remain applicable (Rome I Regulation, Art. 6). The European Online Dispute Resolution (ODR) platform is available at: https://ec.europa.eu/consumers/odr
